Fees for Property Environmental Searches and Regulatory Closure Reviews

The Department regulates the clean-up of impacted sites. As part of the process, the Department undertakes searches for property environmental information (often for a Phase I Environmental Site Assessment). The Department also completes reviews of environmental reports and the completed Record of Site Condition prior to acknowledging regulatory closure of impacts at a property.

As of May 1, 2015, there will be fees associated with the environmental information searches for properties, and for regulatory closure reviews.

Property Environmental Search

The Waste Management Section conducts searches of Department files for property owners and purchasers and their environmental consultants, lawyers, and realtors. This is often conducted as part of a property transfer.

Requests for searches for environmental information on a property should be sent to envsearch@gov.nl.ca, and should contain at a minimum the following information:

  • Property address, including street number, street name, and community (if available)
  • Survey information and detailed description of property location (if property address not available)
  • Map/drawing showing the property location (colour copy preferred)
  • A scanned copy of the payment cheque (if mailing cheque to ENVC) or receipt from Central Cashier's Office

Notes:

  1. Definitions of each land use as per Atlantic Risk-Based Corrective Action (RBCA) User Guidance (Version 3), July 2012.
  2. Agricultural land use, when encountered, is to follow commercial fee structure.
  3. Undeveloped land is to follow residential fee structure.
  4. Only one property per request.
  5. Fee is non-refundable, and is charged whether or not information is found during the search.

Payment can be made to the Department (by cheque) or through the Central Cashier's Office (729-3042).  Please quote account name ENV-Impacted Sites.  Please make cheques payable to NL Exchequer. 

The Central Cashier's Office accepts payment in person by cash, debit, Mastercard or Visa.  Payment can also be made to the Central Cashier's Office by telephone (up to $150), or by mail (money order or cheque).  Please ensure a receipt is obtained for proof of payment to the Department.

Regulatory Closure Review

The Impacted Sites Management Section (ISMS) completes reviews of environmental site assessment, risk assessment, remedial action/risk management plans, and monitoring reports for impacted sites.  Once satisfied that the Impacted Sites Management Process has been followed and the impacts have been satisfactorily addressed, the ISMS reviews and signs off on the completed Record of Site Condition, which serves as acknowledgment of regulatory closure from the Department.

  5. These fees do not apply to Tier I reviews being completed by GSC-SNL.

Payment of the applicable standard fee is to accompany any submission of a Record of Site Condition.  Proof of payment is required in the form of cheque, scanned copy of cheque, or receipt from Central Cashier's Office.  Payment can be made to the Department (by cheque) or through the Central Cashier's Office (729-3042).  Please quote account name ENV-Impacted Sites.  Please make cheques payable to NL Exchequer.
